“Social Media Competition” (the Contest) is a contest organized by BMW Nelson’s Autohaus (the Organizer) The Contest will commence on the following dates: 04-31 August 2023 Entries received after the Deadline will be ineligible for the Contest

ELIGIBILITY

The Contest is open to all followers of the BMW Nelson’s Autohaus Facebook, Instagram accounts based in Rayong, Thailand. All employees of BMW Nelson’s Autohaus & Sphere Agency and its group of companies, their advertising agencies, appointed distributors, any person involved in any manner with the operations of the Contest, and all immediate family members of the aforementioned person are not eligible to participate in this Contest.

The Organiser reserves the right to disqualify any participant who, in the Organiser’s sole opinion, is ineligible to participate in this Contest under this Clause.

CONTEST MECHANICS

To participate in the Contest, you will need to:

• Like and Follow social media of BMW Nelson’s Autohaus account.
• Share the “DriveGreenBMWNelson” giveaway post into the public.
• Let us know in the comment, “Your favorite i Series model and the reasons why it’s the best for you?”.

PRIZES

Eco Friendly Tote Bags, each valued at 1,916 THB per piece.

The total prize amount is 10 pieces. (1 winner 1 prize)

The total value is 19,160 THB.

The Prize is non-transferable, non-refundable, and non-exchangeable.

The Prize is available to those who reside in Rayong,Thailand.

Should the need arise; the Organiser is entitled to replace the prize with other prizes of similar value at any time without any prior notice.

Failure to respond to the Organiser’s winning contact message through direct message on the social media platform used for entry into the Contest within the stipulated time period will result in forfeiture of the prizes and the winners will have no claim whatsoever against the Organiser, its agents and employees in the event of forfeiture thereof.

The prizes may not be exchanged or sold for cash and are non-transferable.

In the event the winner is not able to receive, take up and/or utilize the Prize as detailed for reasons not attributed to the Organiser, the Organiser reserves the right to select an alternative winner. The Organiser will not arrange for another prize or compensation in kind.

The winner is required to provide contact details, passport or Thai Identity Card themselves, and any other details that may be deemed necessary and relevant for the Organiser in its sole discretion, as and when requested/notified by the Organiser for the purposes of verification. Proof of mailing, faxing, or delivering (in any manner whatsoever) any details to the Organiser does not denote proof that the Organiser has received such details.

The Organiser reserves the right to forfeit any prizes due to the failure of any winner to provide the required details upon receiving the request/notification from the Organiser and the Organiser shall have no liability to the winners in any respect whatsoever.

The Organiser reserves the right to appoint a third party to conduct the verification of the winner and validate entry authenticity and the winner agrees that the Organiser may provide all necessary information of the winner to such third party to facilitate such service.

The Prizes are strictly non-transferable, assignable, exchangeable, or redeemable by the winner in any other form or manner other than that specified by the Organiser.

All specific or special terms and conditions that are attached to the Prize must be adhered to by the winner.

In the event that the winner chooses not to accept a Prize, the Prize shall be forfeited, and the Prize shall be dealt with in accordance with the absolute discretion of the Organiser.

Prizes must be collected in accordance with the dates and destinations specified by the Organiser, failing which it shall be forfeited. No cash alternative or alternative arrangement will be offered by the Organiser, its agents or sponsors.

The Organizer shall not be responsible for any additional expenses/fee incurrence during the use of the prize and should be borne fully by the winner.

Use of the prize shall be at the winner’s and his/her guests’ own risk. The winner and his/her guests should always act in a safe and responsible manner.

ELIGIBILITY TO WIN

Eligible Participants must fully comply with the Terms & Conditions and/or the Contest Mechanics stated herein. Incomplete entries and/or the failure to fulfill all or any of the Terms and Conditions and/or the Contest Mechanics will automatically disqualify the Eligible Participant from the Contest without any prior notice.

The Organiser reserves the right to change, vary or amend these Terms & Conditions, the Contest Mechanics, and/or any other matters related thereto at its absolute discretion and without any prior notice.

The winners are fully responsible for any injuries, damages or claims as a result of or arising from their participation in the Contest, usage of their prize and/or collection of their prize. The Organiser accepts no responsibility for lost, misdirected, illegible, late, mutilated or altered entries. Entries that do not comply with these Terms and Conditions will be disqualified without any prior notice.

HOW WILL THE WINNERS BE ANNOUNCE?

Winners will be announce on BMW Nelson’s Autohaus Facebook page, and notified via direct message through the social media platform they used to submit their entry on 10 September 2023. Failure to respond within three days starting from the date of the notification message may result in forfeiture of the win.

USAGE OF CONTEST MATERIALS

The Organiser is entitled, and the winners irrevocably and unconditionally permit the Organiser to use, publish or feature the winner for publicity and advertising purposes in any of the Organiser’s publications, websites, and/or any promotional materials deemed related to the Contest.

The Organiser reserves the right and discretion to delete, remove, not consider or reject any content and/or entry that the Organiser determines to be improper or offensive in any possible way.

OTHER TERMS AND CONDITIONS

The Contest is organized in the English language. However, Contest Entries (as hereinafter defined) can be made in either Thai or English language.

By entering the Contest, Eligible Participants shall indemnify and hold harmless the Organizer, its agents, servants, employees or representatives from and against any and all claims, suits, judgments, damages, liabilities and losses, including costs and expenses incidental to of any nature whatsoever and regardless how caused, arising out of or attributable to, and shall claim full responsibility for the submission of their contest entries for any usage of any copyrighted / trademarked content in their submissions.

Any individual who attempts, is suspected of or otherwise encourages, directly or indirectly, the entry of multiple or false contact information under multiple identities, or uses any device or artifice (whether through Facebook or otherwise) to enter or encourage, directly or indirectly, multiple or false entries or to falsely or unfairly boost their points accumulation and/or winning chances, as determined through investigations conducted by the Organiser (or any appointed third party), will be disqualified.

The Organiser reserves the right in its absolute discretion to disqualify any participant or winner from the Contest at any time and may refuse to award any prize to a person who is disqualified, deemed ineligible, and/or has violated any rule, gained an unfair advantage or obtained winner status using or through suspected use of fraudulent, unfair or illegitimate means. The judges’ decision is final, conclusive, and binding, and no further appeal, inquiry, and/or correspondence will be entertained.

The Organiser reserves the right to cancel, terminate or suspend the Contest without any prior notice. For the avoidance of doubt, any cancellation, termination, or suspension by the Organiser of the Contest shall not entitle the Eligible Participants to any claim or compensation against the Organiser, its agents, and employees for any and all losses or damages suffered or incurred by the Eligible Participant as a direct or an indirect result of the act of cancellation, termination or suspension thereof.

The Organiser shall not be liable for any disruption to the Contest, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of a disruption to the Contest, reasonable efforts shall be used to remedy the disruption and resume the Contest on a fair and equitable basis to the Eligible Participants.

The Organiser will not be liable for any newsfeed disruptions (including invitations or spam) experienced by third parties during the Contest. We advise third parties to temporarily hide the invitations from their friends who are deemed as spamming them during the duration of the contest.

The Organiser, its agents, and employees shall not be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential losses) or personal injury suffered or sustained in connection with or arising from either participation in this Contest or with any of the prizes offered or forfeited.

By entering this Contest, it is deemed that the Eligible Participants have read and have agreed to be bound by these Terms and Conditions. Any breach of these Terms and Conditions may result in forfeiture of any of the prizes at the Organiser’s absolute discretion.

The Organiser reserves the right to vary, delete or add to any of these Terms and Conditions without any prior notice. In case of any dispute, the Organiser reserves the right to the final decision.

These Terms and Conditions will prevail over any inconsistent terms, conditions, provisions, or representations contained in any other promotional materials advertising the Contest.

The Organiser will not use participants’ contact information for purposes other than those specified in the Terms and Conditions.
